Salvatore & Co. LLC (“we,” the ”Company” or ”Salvatore & Co.”) look forward to working with you. Thank you for visiting our website www.salvatoreandco.com. Our mission is to provide you (“you” or “Customer”) with confidence and assurance when doing business with us. All transactions and potential transactions are subject to these Terms and Conditions. These Terms and Conditions may be updated from time to time, either with or without notice to you. We reserve the right, in our sole discretion, to limit or terminate our business under these Terms and Conditions and your access to salvatoreandco.com at any time and for any reason without prior notice or liability. What We Do
Salvatore & Co. sells diamond and fine jewelry, including custom-made items. We also purchase fine jewelry.
Payment
In-Store: Salvatore & Co. accepts in-store payment in the form of credit card (Visa, MasterCard, American Express, Discover), debit card, bank wire, PayPal, Venmo, cashier’s check, personal check and cash. We also offer layaway plans to fit your financial needs.
Website: For website purchases we accept all major credit cards, debit cards, PayPal and Apple Pay (Apple Pay is only available via a mobile device.) Please contact us for more information.
Shipping
Items are typically mailed within one (1) business day depending on availability and any special requests or adjustments you would like made. Time may vary for adjustments made to your order such as sizing, engraving, etc., and to custom orders.
Items are shipped via USPS, UPS, Fedex, DHL, by way of Brinks, Parcel Pro or Malca-Amit at our discretion. Items are shipped fully insured according to the purchase price. Shipping and insurance is added to the total order price.
U.S. Orders: Website shipping costs for items under $1,000 are for USPS Ground Advantage Mail. If you would like an item under $1,000 to be shipped Priority Mail or overnight, enter at checkout under Special Requests (additional shipping costs will apply.) Website shipping costs for items more than $1,000 are for Priority Mail or overnight delivery, determined at our discretion. Priority Mail is typically delivered in 1 - 3 business days and is not guaranteed. Overnight shipping will arrive the next business day. If you need Saturday delivery, enter at checkout under Special Requests (additional shipping costs will apply.)
International Orders: Website shipping for orders being shipped outside of the United States will be shipped via the carrier of our choice depending on the purchase price and your location. The Customer is responsible for all import duties and taxes. Salvatore & Co. will not be held responsible in any way for a Customer who does not pay import duties and taxes upon delivery.
Returns
We expect the recipient of a piece of jewelry from Salvatore & Co. to be absolutely delighted. However, if for any reason you would like to return an item, we offer an exchange for in-store and over-the-phone purchases within 14 days, and a refund for website purchases within 14 days (minus a 6% transaction fee.)
In-Store and Over-The-Phone: For in-store purchases you must return the item to the store within 14 days of your purchase. For over-the-phone purchases, or if you purchased in store but cannot make it back to the store, you must notify us in writing of the return and ship the item back to us within 14 days of the initial tracking showing the item was delivered to you. The Customer or recipient may exchange the returned item for another item in stock of equal or lesser value. If the chosen item for exchange is of lesser value a store credit will be issued for the remaining balance. The Customer may also purchase an item of greater value and apply the amount of the returned item towards the new purchase price.
Website: For website purchases, you must notify us of the return in writing, including sending an email to returns@salvatoreandco.com, and ship the item back to us within 14 days of the initial tracking showing the item was delivered to you. For website purchases, the refund will be applied to the original form of payment. In the event it is not possible to refund the original form of payment, a store credit will be issued.
Any item to be returned must be accompanied by the original receipt, jewelry box, appraisal and laboratory grading report if applicable; and it must be unworn and in its original condition. We have the right to refuse return or charge for repair if we see fit.
The following items and services cannot be returned, exchanged or refunded: custom-made items, items that we purchased from a manufacturer or supplier at a customer’s request, costs for shipping, return shipping, cleaning, polishing, sizing, engraving, appraisal, or any other services of any kind.
The Customer is responsible for all initial and return shipping costs. The Customer shall bear all liability while an item is in transit to us.
Selling to Us
To sell and item to Salvatore & Co. you must be eighteen (18) years of age or older. Every Customer must be the actual legal owner of any and all property sold or attempted to be sold to to Salvatore & Co., and that property must be owned free and clear of any liens, claims, security agreements or other encumbrances or defects in title. Every Customer must be acting on his or her own behalf and not as the agent or representative of another person. By selling or attempting to sell any item to Salvatore & Co., you agree to hold Salvatore & Co. harmless from any claims brought by a third party claiming ownership of any items Salvatore & Co. purchases from you.
You must provide your valid driver’s license or government issued ID to sell an item. Salvatore & Co. may, but shall not be required to, request additional documentation or other proof of compliance with the requirements listed above. We reserve the right to reject any Customer or potential Customer.
You will not give Salvatore & Co. any false or misleading information. You will not send hazardous materials to us. You will not use Salvatore & Co. for any unlawful purpose, including money laundering. You will not impersonate any person or entity, or give false information to misrepresent your association with another person or entity.
In the case you sell or attempt to sell an item to us, Salvatore & Co. will appraise and authenticate it. During the appraisal and authentication process it is sometimes necessary to remove a diamond or other precious stone. We will get your consent to remove a diamond or other precious stone before doing so. In the event you choose to have us remove the stone, it will be your financial responsibility to have the stone reset. It may also be necessary to place certain acids on metals, or to scratch or scrape items in order to remove the top layer of material so that the testing apparatus can accurately determine the true grade or karat of the item in question. All such activity will be carried out by the Company in accordance with customary business practices in appraising secondhand jewelry. You hereby acknowledge and agree that Salvatore & Co. is not liable for any damages caused during the appraisal process so long as Salvatore & Co. acts with reasonable care.
If you do not accept our offer or if we are not interested in purchasing your item, your item will be returned to you.
If you are not able to pick up your item in store and you would like your item shipped to you, you are responsible for all shipping charges. We will send an invoice to you for shipping with the shipping carrier and method of our choice, unless you send us a prepaid shipping label. If you would like to pay for additional insurance and/or shipping extras, you must notify us immediately so we can revise the invoice. Payment on the invoice is due upon receipt. If payment is not made on an invoice within thirty (30) days the Company reserves the right to classify the item associated with the unpaid invoice as lost property.
Mailing an Item to Us
If you mail an item to us for a return, repair, to potentially sell or any other reason, you are responsible for packaging your item in a secure manner. Should Salvatore & Co. receive a damaged or open package, we reserve the right to return the package to you without any liability. Salvatore & Co. reserves the right, in its sole discretion, to reject delivery of any mail, envelope or package, which appears to be damaged, opened or tampered with in any way. Salvatore & Co. shall have no liability to any Customer for any such attempted delivery or return of any such items. Salvatore & Co. may open packages under video and will be deemed to have received your item when it is actually delivered to Salvatore & Co. The Customer shall bear all risk of loss or damage while an item is in transit. Additionally, it is always the responsibility of the Customer to file any claims with the shipping carrier for any lost, damaged or undelivered items.
Returned Items
If for any reason Salvatore & Co. sends an item to you and our mail carrier is not able to deliver the package to you because it has been unable to obtain a signature, the carrier may attempt another delivery. If the carrier is still not able to acquire a signature, it may be returned to us. Also, if you have moved or provided an incorrect address the package may be returned to us.
On our receipt of the returned package, we will contact you to arrange for the package to be resent. However, the Customer will be responsible for the cost of the reattempt shipping, insurance and any extras, even if the Company agreed to pay for the initial shipping. Salvatore & Co. will issue an invoice for the total reattempt shipping costs based on our choice of shipping carrier and method. Salvatore & Co. will not return the item until payment of the invoice is received. If payment is not made on an invoice within thirty (30) days the Company reserves the right to classify the item associated with the unpaid invoice as lost property. Salvatore & Co. is not liable for any items becoming damaged in transit.
Lost Property
You must include accurate contact information when purchasing an item to be shipped to you, or when shipping an item you own to Salvatore & Co. to repair, potentially sell or consign with us or any other reason. If you do not, we will not be able to contact you or identify you as the buyer or owner. If we are not able to contact or identify you (or if there are no communications for a period longer than thirty (30) days), then the item may be classified as lost property.
Salvatore & Co. will hold lost property for at least three (3) months in a secure area. A Customer who wishes to claim an item must fill out a Claim Form. The Customer will be required to provide a thorough and detailed description of the item before we will assign the item to that Customer. Once the Lost Property Claim has been confirmed, we will release the item to the Customer or owner. If after three (3) months no one has claimed the Lost Property, Salvatore & Co. may, but is not obligated to, issue a store credit for an item purchased, mail a check for the offer price of an item the Customer wanted to sell, or mail a check for the fair market price of an item the Customer left at the store for any other reason to the address provided whereupon the transaction shall be deemed completed.
Limitation of Liability
This limitation of liability shall be binding on each and every Customer and any third party, including but not limited to, the Customer and the Customer’s successors, assigners, insurance carriers and any other individual or entity asserting any right or claim relating to the Customer’s transaction or attempted transaction with Salvatore & Co. In no event shall Salvatore & Co. be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence, except as stated herein. In no event shall Salvatore & Co. be liable to any third party, including any insurance carrier. Salvatore & Co. shall not be liable for any subrogation claim brought by the Customer’s insurance carrier, and by submitting an item to Salvatore & Co. Customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.
The liability of Salvatore & Co. is and shall be expressly and specifically limited to the LESSER of the following sums:
1. The lowest value of the item(s) provided in an estimate to potentially purchase
2. The actual wholesale fair market value of the item(s).
The Customer acknowledges and agrees that the Company’s estimated wholesale fair market value of any item(s) inspected by it shall be conclusive and binding.
Salvatore & Co. shall not be liable to anyone for any special or indirect damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity. By sending any items to Salvatore & Co., Customer explicitly and expressly accepts this limitation of liability.
Indemnity
You agree to indemnify and hold Salvatore & Co., its subsidiaries and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Salvatore & Co., salvatoreandco.com, or any other online platform or communication with Salvatore & Co. in violation of these Terms and Conditions and/or arising from a breach of these Terms and Conditions.
Communications
We may request that you send certain information or confirmations to us via writing. Although email is the fastest and easiest, if for any reason you are not comfortable sending information to us via email and would rather send information to us via mail, please feel free to do so.
Your Consent To Receive Email Communications From Us
You hereby grant us the right, from time to time, at our discretion to send commercial, advertising or informational emails to your email address. You acknowledge that we may rely upon you providing Salvatore & Co. with your email or your usage of salvatoreandco.com as your permission to send such emails to you. Furthermore, you grant us the right to continue to send such emails to you until you specifically notify us that you wish us to stop sending you such emails.
Choice of Law, Waiver, and Claims
The Terms and Conditions and any contract or offer for the purchase and sale of any item shall be governed by the laws of the State of New York without regard to its conflict of law provisions. Salvatore & Co.’s failure to exercise or enforce any right or provision of these Terms and Conditions will not be deemed to be a waiver of such right or provision. If any provision of hereof is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.
Any claim or cause of action arising out of or related to use of the services offered by Salvatore & Co., or any contract or offer for the purchase or sale of any item, must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the State of New York. Salvatore & Co. shall be entitled to reimbursement for any and all costs incurred by defending any civil action filed or attempted to be filed in any jurisdiction other than the State of New York, including but not limited to, attorney’s fees incurred by Salvatore & Co.
